Terms of Service

1. Definitions
Artist - The individual in charge of producing your commissioned artwork.
Client - The individual purchasing the commission.
Commissioned artwork - May also be referred to as “artwork” or “commission”. The piece of art paid by the client and produced by the artist.

2. Product
The artwork commissioned will be sent to you in form of a digital file. Usually this will be a PNG file, although other file types may be requested.
This is no physical product and nothing will be shipped to the client physically.

3. Process
The client sends a commission request via messaging on social networks or e-mail (contacts listed below) with a description what they would like to commission. The more information, the better.
After the price has been discussed, a Paypal Invoice will be sent. The artist will start working on the commission after they have received the payment.
The commission status will be listed on the public queue for the client and artist to keep track of. The status shown on the queue is regularly updated, but may not always be exactly up-to-date.
A sketch will be sent to the client via the same means of contact the artist has been initially contacted by. At this point minor changes can be requested. If the client wishes to be contacted by different means, they must communicate the artist to do so.
Further updates on the drawing can be sent, if requested.
After the commissioned artwork has been finished it will be uploaded on social media. If requested it can also be sent via e-mail.

4. Usage
The commissioned artwork may be used by the client for personal usage. If used publicly, such as on social media, the artist’s watermark shall remain on the image or alternatively credit in form of the artist’s online username or URL to their social network profiles shall be given.

The commissioned artwork may not be reposted online without credit and may not be claimed to have been drawn by another individual.
The commissioned artwork may not be used for paid productions such as game graphics or prints unless discussed otherwise.
The commissioned artwork may not be sold at a significantly higher price than initially purchased, especially not in forms of NFT.

5. Times and Deadlines
Unless a clear deadline is given, the process of the artwork may take weeks up to months. Estimated times may be requested, but unless clearly stated so, are not binding. The client is always free to ask for updates.
The client may ask for a deadline at which the commissioned artwork should be finished. If done so, the artist will estimate whether this is possible or not and do their best to finish the commission within time. If due to any circumstances they find out they won’t be able to finish it, the client will be notified and a refund may be requested.
Requesting a deadline may result in additional fees.

6. Public Display By The Artist
The commissioned artwork may be shown publicly on their queue and posted by the artist on their social media, including credit to the client. If the client wishes to stay anonymous or wishes their piece to not be publicly posted, this must be explicitly requested.
Keeping the client anonymous will always be free, however requesting the artwork to not be public may result in additional fees.

7. Refund Policy
In case of cancellation of the commission by the client the money may be refunded, although the artist will keep the amount it cost up to the current status of the piece. In example, if the client commissioned a lined and colored piece and asks for a refund, but the sketch has already been finished, the client will be charged for the finished sketch. The rest may be refunded.
The artwork in it’s current status may be sent to the client if requested.

In case of cancellation by the artist the commission may be refunded fully, regardless of the status of the commissioned artwork.

8. Acceptance Of Commission
The artist retains their right to refuse and cancel commissions for any reason. The artist will not be discriminative of minorities and protected characteristics, but may not work with individuals based on their public behavior or believes.
